Starting a business means business regulations....

Most small business advisors recommend that you at least file a fictitious name, a small business license and obtain a tax id number, which can be a business id and it is called a federal tax id number EIN. It is recommended that you incorporate or form an LLC but you don't have to if you file a dba.  Note that if the products you will sell are taxable to the public, you will need a wholesale or retail license, as well.  Read more below.

HERE'S WHAT YOU NEED:

•  All small business owners starting a business need (including Online E-Commerce, Ebay, and home businesses) a business license, which is not the same as incorporation, forming an llc or getting a wholesale license.

•  Even if you incorporate or form an llc and you are  using a name other than the corporation or llc name or own personal or legal name, you need to obtain a DBA business name certificate.

•   Starting a small business, even if it is an eBay, online, or internet business and you sell taxable items or services you need to obtain a seller's permit or retail license / wholesale License.

•  Employers must obtain a federal tax id number (EIN) and a state tax id number (EIN). How to Get a Tax Id Number

•  If you form an LLC or you incorporate, note that corporations, and LLCs must obtain a federal tax id number (EIN) and a business license.  In addition, a wholesale license if taxable items are sold, and a state tax id number if any hiring of employees occurs.

•    Small Business owners, even those starting a new small business out of their home, online or internet small business, and want to protect themselves against personal, civil, and financial liability arising out of business transactions should incorporate, or form an LLC but note incorporation or llc formation does not mean you don't have to get a business license.  Read below how to get a business license or how to get a  wholesale license. All businesses need a business license but, first, file a DBA Fictitious Business Name or Form an LLC or  Incorporate Your Business: Even thought if you incorporate or form an llc, you will have civil and debt protection, if business name is (e.g., Carpet Express) other than your personal name (e.g., John Smith), you need to register and publish a DBA Fictitious Business Name, or Incorporate. Note that if you incorporate or form an llc, you don't have to file a dba but you need to obtain a tax id number, which can be a business id and it is called a federal tax id number EIN

Benefits: You need a fictitious business name statement certificate or a corporation certificate so you can open a merchant or business bank account.

Second, get a Federal Employer Number FEIN or Federal Tax Id Number, What is a federal tax id number?  A federal tax id number is required for employers and corporations or llcs, but get a federal tax id number and use it instead of your social security number because if you don't get one, you will need to use your social.

Third, in California, you need a State Tax Id Number: EIN Employer ID, if you have employee (s).  Note: you must have a federal tax id number before you can obtain a state tax id number.

Fourth, A Wholesale License or Resale License: same as a Seller's Permit, Sales Tax Certification, Wholesale License -- you need a sellers permit if you buy or sell wholesale or you sell retail - you don't pay taxes when buying wholesale. Example, you sell computers or clothing online in California.. you need a sellers permit to buy wholesale tax free. When you sell, you charge taxes (collect taxes) to pay to government later.

Fifth, Business License: All businesses need a business license.  Note: you need a DBA fictitious business name to open a bank account - not a business license. Also, businesses need to identify themselves with a federal tax id number or a social security number. Don't use your social to do business.  Get a federal tax id number even if it is optional.

Note incorporating or forming an llc, it will not cancel the business license required.
